It occurs when the employee considers that the cause applied by the employer to dismiss him is based on facts or circumstances that are not such or on the company’s needs that are debatable or unreal.

 ¿What should I do if I consider my unjustified dismissal?

If your dismissal occurs for reasons for which the employer is responsible, as needs of the company for example, in this case you are entitled to compensation, as also the employer must give prior notice, unless you replace the previous notice compensating the worker.

You must differentiate if your dismissal occurs for reasons for which the worker is responsible, as for example would be the abandonment of the workplace. In this case the worker has no right to receive any type of compensation nor the employer to give prior notice. This is known as wrongful dismissal.
